HOA Reform

The Texas Property Code, specifically Chapters 209 (Texas Residential Property Owners Protection Act) and Chapter 207 (Disclosure of Information by Property Owners’ Associations) are in need of reform. Currently, the laws allow for Taxation without Representation by developers who can retain control of HOA boards indefinitely. There is little oversight, transparency and consumer protections built into these statutes and HB 3445 was created to alleviate the unintended consequences of the current laws for homeowners.

This 86th Legislative Session, Texas House Representative Tracy O. King introduced HB3445, which aimed at HOA Reform. I am proud that Homeowners Voices United was able to bring awareness to the need for reform and that our District Representative, Tracy O. King was able to bring a bill forward for consideration. We are eager to continue working with Representative King on this much needed reform.

The Booklet We Created For the Business and Industry Committee Hearing

House Bill 3345 was written with the following goals:

  • to ensure homeowners living in Homeowner Associations have the opportunity to participate in their own governance.
  • to allow homeowners to obtain majority control once the community is 75% built out or after 5 years following the creation of the community if the number of lots are not listed in the original declaration.
  • to increase transparency by requiring Associations maintain records online instead of the current request for documentation process.
  • to require that Associations maintain a publicly accessible website with all governing documents available to current and potential members.
  • to hold developer-controlled associations to the same standards homeowner-controlled associations must adhere to with regards to spending Association monies.
